Agreement to Terms

These Terms of Service ("Terms") govern your use of Tavoxsms's SMS marketing platform and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access our services.

Our Services

Tavoxsms provides a comprehensive SMS marketing platform that includes:

  • Bulk SMS campaign creation and management
  • AI-powered message optimization and personalization
  • Contact list management and segmentation
  • Automated SMS responses and AI agents
  • Campaign scheduling and analytics
  • Two-way messaging and conversation management
  • Phone number management and compliance tools

Account Terms

To use our services, you must:

  • Be at least 18 years old or have parental consent
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

Acceptable Use

You agree not to use our services to:

  • Send spam, unsolicited, or illegal messages
  • Violate any applicable laws or regulations
  • Harass, abuse, or harm others
  • Impersonate others or provide false information
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of our platform
  • Use our services for any illegal or unauthorized purpose

Important: You are responsible for ensuring compliance with all applicable laws and regulations. Tavoxsms provides tools to help with compliance but cannot guarantee your compliance.

SMS Compliance & Regulations

When using our SMS services, you must comply with all applicable laws and regulations, including:

  • TCPA (Telephone Consumer Protection Act) in the US
  • GDPR (General Data Protection Regulation) in the EU
  • Local SMS marketing and privacy laws
  • Carrier-specific requirements and guidelines
  • Opt-in/opt-out requirements for recipients

You are responsible for obtaining proper consent from message recipients and maintaining accurate opt-out lists.

Third-Party Providers, Platform Role & User Liability

Tavoxsms operates as a software platform that helps you orchestrate SMS campaigns. Message transmission, phone number provisioning, and carrier connectivity are provided by independent telecommunications providers (e.g., Twilio or similar) that you authorize us to use on your behalf.

  • User Responsibility: You are solely responsible for the content, recipients, timing, and targeting of your campaigns and any consequences arising from them.
  • No Assumption of Liability: To the maximum extent permitted by law, Tavoxsms is not liable for user-generated content, unlawful use, carrier filtering, blocked traffic, account suspensions by carriers, or any regulatory penalties caused by your use of the services.
  • Indemnification: You agree to indemnify, defend, and hold harmless Tavoxsms and its affiliates from and against any claims, fines, penalties, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your campaigns, your content, your failure to obtain valid consent, or your violation of laws, carrier rules, or these Terms.
  • Prohibited Uses: Fraud, phishing, scams, illegal marketing, harassment, or deceptive practices are strictly prohibited. We may suspend or terminate access, with or without notice, when we suspect abuse or receive complaints from carriers or authorities.

Identity Verification (KYC) & Compliance Checks

To reduce fraud and comply with carrier and regulatory requirements, Tavoxsms may require identity verification ("KYC") for account owners and/or organizations before enabling or continuing messaging capabilities.

  • You agree to provide accurate business and identity details and to keep them up to date.
  • We may validate information with verification vendors and/or telecommunications providers.
  • Failure to pass or complete verification may result in restricted features, blocked traffic, or account suspension.

Cooperation with Carriers & Authorities

You authorize Tavoxsms to cooperate with carriers, verification partners, and law enforcement when we receive lawful requests or abuse reports related to your use of the services. We may implement traffic shaping, rate limits, or blocks to protect the platform and comply with carrier requirements.

You agree to promptly respond to compliance inquiries and provide evidence of recipient consent upon request.

Billing & Payments

Our pricing structure includes:

  • Subscription plans with monthly SMS credits
  • Pay-per-message options for additional usage
  • Phone number rental and management fees
  • Premium features and add-on services

All fees are charged in advance and are non-refundable except as required by law. We reserve the right to modify our pricing with 30 days notice.

Data & Privacy

Your privacy is important to us. Our data practices are governed by ourPrivacy Policy. By using our services, you acknowledge that:

  • We process personal data as described in our Privacy Policy
  • You have obtained necessary consents from your contacts
  • You will handle contact data responsibly and securely
  • You will respect opt-out requests from recipients
  • You are responsible for data accuracy and updates

Intellectual Property

Tavoxsms retains all rights to our platform, software, and intellectual property. You retain rights to your content and data. You grant us a limited license to use your content solely for providing our services.

Limitation of Liability

To the maximum extent permitted by law, Tavoxsms shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or technical issues
  • Third-party actions or content
  • Compliance failures or legal violations by users

Our total liability shall not exceed the amount paid by you for our services in the 12 months preceding the claim.

Termination

Either party may terminate this agreement with 30 days written notice. Upon termination:

  • Your access to our services will be suspended
  • We will retain your data for the specified retention period
  • You will remain responsible for any outstanding fees
  • We will provide you with a data export if requested

Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes via email or through our platform. Continued use of our services after changes constitutes acceptance of the new Terms.
